By engaging services provided by fnx creative, the Client agrees to the following Terms and Conditions.

1. Scope of Services

fnx creative provides social media content creation services including but not limited to:

Short-form video reel scripting
Editing and post-production
Caption writing and optimization
Content strategy guidance
Social media optimization for platforms such as Instagram, TikTok, and Facebook

Specific deliverables and reel quantities are defined within the Client’s selected monthly package or written agreement.

2. Monthly Retainer Structure

Monthly packages reserve production time, creative planning, and editing capacity.

Services are delivered according to the agreed number of media productions per month.
Additional media productions beyond the package are billed at the agreed per-production overage rate.
Monthly retainers do not automatically roll over unused deliverables unless explicitly stated in writing.

3. Payment Terms

Payment is due in full at the beginning of each monthly service period.
Work will not begin until payment has been received.
Late payments may result in delays or suspension of services.
Prices are listed in CAD unless otherwise stated.

4. Refund Policy

Due to the nature of creative and production services:

All payments are non-refundable once the service period has begun.
Monthly retainers secure production time, planning, and creative development.
Work completed or in progress — including scripting, editing, and planning — is non-refundable.

Client satisfaction is supported through the included revision process rather than refunds.

5. Revisions

One (1) revision round per production is included unless otherwise specified.
Additional revisions may be billed at an hourly or per-revision rate.
Revisions must be submitted as one consolidated request.

6. Client Responsibilities

The Client agrees to:

Provide raw footage or attend filming sessions as agreed
Supply project information, branding assets, and relevant materials
Provide timely feedback and approvals
Ensure all information supplied is accurate and authorized for use
Delays in Client communication may affect delivery timelines but do not pause billing periods.

7. Content Approval

The Client is responsible for reviewing and approving all final content prior to posting.

Once content is approved and delivered:

fnx creative is not responsible for performance metrics, algorithm changes, or audience engagement outcomes.

8. Intellectual Property & Usage Rights

Upon full payment:

The Client receives usage rights for the delivered content on their business social media channels.
fnx creative retains the right to display completed work in portfolios, marketing materials, and promotional content unless otherwise agreed in writing.

Raw project files remain the property of fnx creative unless purchased separately.

9. Cancellation & Termination

Either party may terminate monthly services with thirty (30) days written notice.
Work scheduled during the notice period remains billable.
Cancellations of scheduled filming sessions with less than 48 hours notice may incur a cancellation fee.

10. Turnaround Times

Estimated delivery timelines depend on:

Client responsiveness
Footage availability
Project scope

Rush requests may be subject to additional fees.

11. Limitation of Liability

fnx creative shall not be liable for:

Social media platform outages
Algorithm changes
Account restrictions
Loss of business revenue or indirect damages related to content performance

12. Acceptance of Terms

By purchasing services or continuing to use services provided by fnx creative, the Client acknowledges they have read and agreed to these Terms and Conditions.
